OLG Braunschweig: Ärzte sind Beauftragte der Krankenkassen
Ein Beschluss des Oberlandesgerichts Braunschweig könnte die Spielregeln für die Beziehungen zwischen Ärzten und Pharmaindustrie ziemlich durcheinander bringen. Die Richter urteilten, dass Kassensärzte als Beauftragte der Krankenkassen handeln.
Damit unterlägen die Ärzte dem § 299 des Strafgesetzbuchs – Bestechlichkeit und Bestechung im geschäftlichen Verkehr. In dem vorliegenden Fall hatte ein Braunschweiger Apotheker einem Arzt mit 187000 DM den Umbau seiner Praxis finanziert und später monatlich an die 2000 Euro Mietkostenzuschuss überwiesen. Im Gegenzug habe der Arzt nach Auffassung der Staatsanwälte den Apotheker unter anderem bei den Verschreibungen von Zytostatika bevorzugt.
Nach dem Urteil, wenn es Bestand hat, könnten Ärzte zukünftig wegen Vorteilsnahme oder Vorteilsgewährung bestraft werden. Dementsprechend eindeutig fällt die Bewertung aus: Die Leiterin der Zentralstelle für Korruptionsbekämpfung bei der Staatsanwaltschaft Braunschweig sieht in dem Bechluss ein Erdbeben. Die Krankenkassen reagierten ausgesprochen zustimmend. Während die KV Niedersachsen und eine Ärztekammer die Freiheit des Arzt bedroht sehen und eine Kriminalsierung befürchten.
Die Ausweitung des § 299 StGB auf Kassenärzte bedeutet jedoch auch ein Strafbarkeitsrisiko aus steuerlicher Sicht für die Pharmaindustrie. Ausgaben, die ein Verstoss gegen § 299 sind, unterliegen dem Betriebskostenabzugsverbot, sprich: Jeder Buchhalter, der derzeit och einen Cent an einen Arzt für was auch immer zahlt (Essen, Kongressreise, Bürostuhl etc.), könnte im Nachhinein damit rechnen, wegen Steuerhinterziehung zur Verantwortung genommen zu werden. Das Urteil sollte im Controlling und bei den Finanzverantwortlichen der Pharmaindustrie bekannter werden. Denn eine Ordnungswirdrigkeit bezahlt das Unternehmen aus der Portokasse, bei einem Strafverfahren müssten sie für ihr Unternehmen und das Management den Kopf hinhalten.

"Positioning DETROL (Creating a Disease)"
Im Internet ist eine Präsentation aus dem Jahr 2002 aufgetaucht, in der Neil Wolf, zu dieser Zeit Group Vice President des Pharmakonzerns Pharmacia, auf der Konferenz der Pharmaceutical Marketing Research Group (PMRG) einen Einblick in die Methoden des “Diesease Mongering” gibt. Titel: “Positioning DETROL (Creating a Disease)”.
Es geht dabei um Detrol® (in Deutschland Detrusitol®), ein Medikament, das zur Behandlung der “überaktiven Harnblase” (OAB – Overactive Bladder) eingesetzt werden sollte. Nur gab es damals dieses Krankheitsbild “trockene Inkontinenz”, noch nicht. Ein Nischenprodukt sollte in den Massenmarkt gedrückt werden.
Zur Einordnung: Kurz zuvor war Pharmacia von Pfizer gekauft worden.
