Lilly zahlt 63 Millionen Dollar an US-Bundesstaaten
Der Pharmakonzern Ely Lilly hat sich mit 33 US-Bundesstaaten auf eine Zahlung von 63 Millionen Dollar geeinigt. Lilly hatte das Medikament Zyprexa®, das zur nur Therapie von Schizophrenie und Bipolare Störungen zugelassen war, auch zur Behandlung von Demenz und milden Formen der Bipolaren Störung vermarktet, was interne Dokument von Lilly belegen.
Die Summe übersteigt die 58 Millionen Dollar, die Merck & Co. in einem ähnlichem Fall wegen des irreführenden Marketings von Vioxx im Mai dieses Jahres zahlen musste.
Weitere 63 Millionen Dollar, zu den mehr als mehr als 1 Milliarde Dollar, die dem Konzern das off-label Marketing und das Verschweigen der Nebenwirkungen von Zyprexa® bisher gekostet hat. Ein Prozess mit US-Bundesstaaten steht noch aus, in dem Lilly wiederum 1 Milliarde Dollar loswerden könnte. Bei 4,3 Milliarden Dollar Umsatz mit Lillys wichtigsten Medikament allein 2007 ist das fast zu verschmerzen.
Für das Bietergefecht um das Biotech-Unternehmen Imclone, das Lilly mit 6,5 Milliarden Dollar für sich entscheiden konnte hat es jedenfalls gereicht.
